Terms and Conditions for Transcendent Massage Therapy

These Terms and Conditions ("Terms") govern your use of massage therapy services provided by Transcendent ("we," "us," or "our"), located in Hermiston, Oregon. By booking an appointment or receiving services, you agree to these Terms. We recommend reviewing them carefully. These Terms are intended as a general template and do not constitute legal advice. We strongly advise consulting a qualified attorney to customize this document to your specific needs and ensure compliance with all applicable laws.

1. Introduction

Transcendent provides professional massage therapy services for relaxation, wellness, and therapeutic purposes. All services are performed by licensed massage therapists in compliance with Oregon state regulations, including those set by the Oregon Board of Massage Therapists. Services are not a substitute for medical treatment, and we do not diagnose or treat medical conditions. If you have health concerns, consult your healthcare provider before booking.

2. Services Provided

We offer various massage therapies, including but not limited to Swedish, deep tissue, sports, and prenatal massage. Session durations and types are as described on our website or at booking. All services are non-sexual and professional in nature. We reserve the right to refuse or terminate service if we believe it is inappropriate or unsafe.

3. Booking and Appointments

⚫ Appointments can be booked via phone, email, our website, or in person.
⚫ To secure your appointment, we require a valid credit or debit card to be placed on file at the time of booking. Your card will not be charged at booking unless a deposit is required for certain sessions or packages.
⚫ By providing your payment information and booking an appointment, you expressly authorize Transcendent to charge the card on file for any applicable late cancellation or no-show fees as outlined in Section 5.
⚫ We require accurate contact and health information at booking.
⚫ Arrive 10-15 minutes early for paperwork and consultation. Late arrivals may result in shortened sessions without fee adjustment.
⚫ Minors under 18 must be accompanied by a parent or guardian, who must sign consent forms. We do not provide services to children under 12 without prior approval.

4. Payment Terms

⚫ Fees are based on session type and duration, as listed at the time of booking. Prices are subject to change without notice.
⚫ Payment for services is due in full at the time of service unless otherwise arranged (e.g., packages or gift certificates).
⚫ Accepted payment methods: cash, credit/debit cards (Visa, MasterCard, Discover, American Express), and gift certificates issued by us.
⚫ A deposit may be required for certain bookings or packages.
⚫ Tips are appreciated but not mandatory and go directly to the therapist.
⚫ All fees are non-refundable except as outlined in Section 11.

5. Cancellation and No-Show Policy

⚫ Cancellations or rescheduling must be made at least 24 hours in advance to avoid charges.
⚫ Late cancellations (less than 24 hours' notice) or no-shows will result in a charge of the full session fee.
⚫ This fee will be automatically charged to the credit or debit card you have on file.
⚫ We may waive fees in cases of genuine emergencies (e.g., illness or unforeseen circumstances) at our sole discretion.
⚫ Rescheduling with less than 24 hours' notice may be treated as a cancellation.

6. Client Responsibilities and Health 

⚫ DisclosuresYou must disclose any medical conditions, injuries, allergies, pregnancies, or medications that could affect your treatment. Failure to do so may result in session cancellation without refund and releases us from liability.
⚫ Maintain professional conduct; any inappropriate behavior (e.g., sexual advances, harassment) will result in immediate termination of service, removal from premises, and possible reporting to authorities, with no refund.
⚫ Follow all health and safety guidelines, including hygiene standards.
Inform us of any changes in your health between bookings.

7. Liability Waiver and Disclaimer

⚫ Massage therapy involves physical contact and may carry risks, such as soreness or bruising. By receiving services, you acknowledge these risks and release Transcendent, its therapists, and affiliates from any liability for injuries, damages, or losses arising from services, except in cases of gross negligence or willful misconduct.
⚫ We are not liable for any pre-existing conditions not disclosed or for advice to seek medical care.
⚫ You agree to indemnify us against claims arising from your breach of these Terms or misuse of services.
⚫ Services are for wellness only; we make no guarantees about results or outcomes.

8. Privacy and Confidentiality

⚫ We collect personal, health, and payment information to provide services, process payments, and comply with laws. This information is stored securely using compliant payment processors and used only for your treatment, billing, and communications.
⚫ We adhere to applicable privacy laws, including HIPAA where relevant. Your information will not be shared without consent, except as required by law (e.g., reporting abuse).

9. Age Requirements

⚫ Clients must be at least 18 years old to book independently. Minors require parental consent and supervision as noted in Section 3.

10. Conduct and Etiquette

⚫ Maintain a quiet, respectful environment; silence phones and minimize noise.
⚫ No smoking, vaping, alcohol, drugs, or outside food/drinks on premises.
⚫ No solicitation or business activities by clients.
⚫ We reserve the right to deny service or remove individuals for violations, with no refund.

11. Refunds and Gift Certificates

⚫ Services and packages are non-refundable and non-transferable.
⚫ Gift certificates are non-refundable, valid for one year from purchase, and redeemable only for services. Lost or stolen certificates will not be replaced.
⚫ In rare cases (e.g., service denial for safety reasons), we may issue credits at our discretion.

12. Changes to Terms

⚫ We may update these Terms at any time. Changes will be posted on our website or provided at your next visit. Continued use of services constitutes acceptance.

13. Governing Law

⚫ These Terms are governed by the laws of the State of Oregon. Any disputes will be resolved in the courts of Umatilla County, Oregon.
